By downloading, installing, or using PlantScan, you agree to these Terms of Use and to our Privacy Policy. If you do not agree, please do not use the app.
You must be at least 13 years old (or the minimum age of digital consent where you live, if higher) to create an account. If you are a minor under the age of majority in your jurisdiction, you may only use PlantScan with the involvement and consent of a parent or guardian.
You're responsible for keeping your sign-in credentials secure and for all activity under your account. You may delete your account at any time from Profile → Delete Account; this is permanent and cannot be undone.
PlantScan Premium is an auto-renewing subscription purchased and billed entirely through your Apple App Store account, on the terms Apple discloses at checkout. It renews automatically unless cancelled at least 24 hours before the end of the current period; you can manage or cancel it anytime in Settings → [Your Name] → Subscriptions on your device, or from Profile → Manage Subscription in the app. Refunds are handled by Apple under Apple's own refund policies — we do not have the ability to issue refunds directly. Prices may change; we'll give you notice as required by applicable law before any change affects an active subscription.
Unlimited identification and chat usage under Premium is subject to a fair-use limit of 200 AI requests per calendar month per account, intended to prevent automated abuse of the underlying AI service; this comfortably covers normal use by an individual plant owner. If you reach this limit, you can continue using PlantScan once it resets at the start of the next month, or contact us if you expect to need more.
You agree not to: use the app for any unlawful purpose; attempt to bypass usage limits, security, or the app's account/subscription system; upload content you don't have the right to share; or use the Botanist or analysis features to generate content that is abusive, harmful, or unrelated to plant care in a way that abuses the underlying AI service.
Plant identification, health diagnosis, care instructions, and Botanist chat responses are generated by an AI model and are provided for general informational purposes only. They are not a substitute for advice from a qualified horticulturist, veterinarian, physician, or poison control service.
Toxicity information specifically: identification and toxicity assessments can be wrong, especially from an unclear photo or a visually similar look-alike species. Never rely solely on this app to decide whether a plant is safe around children or pets. If a child or pet may have ingested any part of a plant, contact emergency services, your doctor, your veterinarian, or a poison control center immediately — do not wait for or rely on an in-app answer.
By using these features, you acknowledge these limitations and agree that you are solely responsible for how you act on any information the app provides.
The PlantScan app, its design, and its underlying software are owned by us and protected by intellectual property laws; using the app doesn't transfer any ownership to you. You retain ownership of the photos and text you submit; by submitting them, you grant us the limited right to transmit them to our service providers (see Privacy Policy) solely to provide the app's features to you.
The app is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that AI-generated content will be accurate or complete.
To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, plants, pets, or property, arising from your use of (or inability to use) the app, including reliance on AI-generated identification, diagnosis, or care/toxicity information. Nothing in these terms limits liability where such limitation is not permitted by law.
You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your misuse of the app or violation of these terms.
We may suspend or terminate your access to the app if you violate these terms. You may stop using the app, or delete your account, at any time.
These terms are governed by the laws of Belgium, without regard to conflict-of-law principles, without prejudice to any mandatory local consumer-protection law described below. This applies regardless of where you use the app from — PlantScan is available worldwide, but is operated from Belgium.
If you are a consumer resident in the European Union, the United Kingdom, or another jurisdiction that grants you mandatory local consumer-protection rights, this section does not take those rights away: you may still rely on the mandatory consumer-protection laws of your own country of residence, and, for EU/UK residents, on the online dispute resolution options your local law provides.
We may update these terms as the app changes. Continued use of the app after an update constitutes acceptance of the revised terms; material changes will be reflected by updating the "Last updated" date above.
